     1.  Thomas Patrick4 Wholohan  (Thomas3 Huolahan, Michael2 Holohan, Michael1) was born

17 March 1867 in Greendale, New South Wales, and died 28 May 1903 in Bobs Range, Camden, New South Wales. 

He married (1) Bridget A Dillon 31 December 1891 in Marrickville, Sydney, New South Wales. 

She was born Unknown, and died 28 May 1894. 

He married (2) Minnie Lind 27 July 1896 in St Pauls RC Church, Camden, New South Wales,

daughter of Julius Lind and Annie Rauin.  She was born 1874 in Melbourne, Victoria, and died 15 April 1899 in Bob's Range, New South Wales. 

He married (3) Ellen Higgins 23 August 1900 in Sydney, New South Wales, daughter of John

Higgins and Bridget Wholohan.  She was born 14 September 1870 in Shancamore, New South

Wales, and died 18 September 1933 in Sydney, New South Wales.

Thomas Patricks's father is not listed on his birth certificate. However, his father is Thomas

Huolohan who never married and left Thomas Patrick his property.

Documents relating to Thomas Patrick Huolohan's inheritance of his father's (Thomas Holahan) Camden Property.

Background

Thomas (known as Patrick), at the age of 12 years, inherited his grandfather Cornelius's property.

There were unusual circumstances surrounding this inheritance as Thomas was the Illegitimate

son of Cornelius's youngest daughter Ellen and the said Thomas Huolohan.

It would appear that the will was not contested by any other members of the family, even though

Cornelius had son's of his own and many grandchildren.

Bridget (Thomas's grandmother) had use of the farm until her death (1890).

The property was then held in trust by mother Ellen Bligh (nee Wholohan), and was transferred to

him on the 15th April 1893 when he was 26.

In the Lands Court, it was not a simple matter for the courts to decide "who was this "Patrick

Holohan" who was named in the will of Cornelius Holohan (someone decided to go back to the

original spelling and dropped the "W"). The declaration gives insight into the current spelling of

the family name Huolohan.

Ellen Huolohan (nee Higgins) Sept 14 1870 -  Sept 18 1933

Indicted for the attempted murder of her mother Bridget Higgins

1907

Outline:-

The case for the Crown was that Bridget Higgins was taking certain medicine, which was

contained in a bottle kept in the accused's house. She took come medicine on Saturday June 8,

without ill effect; on the following day, however, she again took some of the medicine, and went

out with the children for a walk. Suddenly she lost the use of her legs, and she took a number of

fits. Subsequently, an examination of the medicine bottle disclosed the presence of Strychnine

crystals.

There was some strychnine in the house, and the Crown's allegation was that the accused was

the only person who knew where the poison was kept. When arrested the accused said to the

arresting police officer, Detective Gallagher, that the poison was kept in a box and that she had

given the key to her mother six months before; she also said that there was a man on the premises

on the Saturday night and he could have tampered with the bottle. At any rate, she had not put

poison in the bottle.

Evidence was given by a witness that in her presence the accused had said that if her mother did

not leave her premises she would to her an injury, as she had been ill treated by her, and that her

mother had robbed her of a fortune.

The accused, in her defence, said from the witness box that before her mother was taken ill the

man Smith was in the room in which the medicine was kept. Smith knew where the poison was,

and on the following day she noticed that the medicine was thicker than usual, she drew her

mother's attention to its altered condition. She sent to the doctor with all possible speed when

her mother became ill.

Recalled at the request of a juryman, Mrs Higgins said that when she took the poisoned medicine

her daughter was in the room, and when she gave a little drop of medicine to the accused's child

the mother did not interfere.

Alfred Smith, on oath, denied that he had poisoned the medicine.

Paul Huolohan, son of the accused, aged nine, gave some evidence concerning the movements

of Smith on the Saturday night. To Mr Pollock, he said he had repeated the story to his mother

until he remembered it.

The jury retired at 3:30pm, and after 2 minutes consideration found the accused not guilty, and

she was discharged from custody.

Observations:-

The mention of Paul as her son - no record of Paul's birth certificate has been found to date.

We do not know who Alfred Smith was and how he had access to the box key.

Did Ellen and Alfred conspire to murder Bridget?

What was the fortune Ellen was said to be robbed of? Her father (John Higgins) left his estate to

his son John Higgins Jnr. Ellen was the only surviving child of the Higgins Family.

It would appear that the statement by Bridget that Ellen did not interfere when her child had a

drop of the poisoned medicine - swayed the Jury to their not guilty conclusion.

However, the fact remains that the Medicine WAS POISONED.

Ellen's son Cornelius "Administrator" of his mother's estate inherits the farm at Camden as oldest

living son from his father. Ellen did not inherit from her husband but had the estate during her life
